Effective date: 16 September 2026.

1. Who we are and these terms

The 111 Foundation operates 111 at 111bpm.com, an international movement for human-made music at 111 BPM, with supporting visual art, writing, and community discussion. In these terms, “111,” “we,” and “us” mean The 111 Foundation. “You” means the person using the service and, when you are authorized to act for an artist identity, that artist or rights holder to the extent of your authority.

These terms govern use of the website and submissions to it. Account holders must affirmatively accept the applicable version before participating. The Privacy Policy explains how we handle personal information; accepting these terms is not blanket consent to optional data processing. Nothing here overrides rights that applicable law does not allow you to waive.

2. Adults-only accounts

You must be at least 18 to create or use an account. You must truthfully declare that you are 18 or older. We record that declaration and when it was made; we do not ask for a date of birth as part of this declaration. A declaration is not independent age verification. Do not provide a false declaration or help someone bypass the restrictions.

Visitors without an eligible adult account can browse non-explicit public material. Explicit material is unavailable to signed-out visitors, accounts without the declaration, and anyone we know is under 18. If we learn that an account belongs to someone under 18, we restrict access and address the account and its information under our Privacy Policy and applicable law.

An account does not automatically provide membership, publication rights, editorial powers, or authority over an artist identity. Membership and capabilities require approval. Keep access credentials secure, use required security measures, and report suspected unauthorized access. Do not share an account or impersonate another person.

3. Your work remains yours

You and the other rights holders retain ownership of your music, recordings, visual art, writing, and other contributions. Uploading, submitting, or publishing work does not transfer copyright to 111, make 111 your record label or publisher, or give 111 exclusive rights. You remain free to use and license your work elsewhere.

Submit only work you own or are authorized to submit and license for the particular uses you permit. Your authority must cover relevant coauthors, performers, recordings, underlying compositions, samples, images, and other contributions. Credit is not a substitute for permission. Do not grant rights controlled by a label, publisher, collecting society, collaborator, or other party unless you have the necessary authority. Disclose relevant restrictions when submitting and keep credits accurate.

Creative expression is welcome within these terms. Published music must satisfy the human-authorship and 111 BPM requirements and the applicable submission declarations. Human editorial review determines what is published; submission does not guarantee publication. Private drafts remain private to authorized controllers and service personnel with a legitimate need to access them. Editorial review receives submitted material according to its permissions.

4. Permission needed to operate the website

To provide the service you request, you give 111 a non-exclusive, worldwide permission to store, back up, technically process, reproduce, and deliver your contributions. This includes displaying and streaming approved public work, showing submitted work to authorized reviewers, and making forum contributions available to authorized members. It does not authorize making private drafts or private discussions public.

Technical processing may include format conversion, image sizing, protected or blurred previews, and other changes needed for delivery, accessibility, and security. It does not authorize remixes or substantive artistic alterations. Service providers may exercise this permission only as needed to operate the service for us, subject to appropriate restrictions. These terms do not promise payment for ordinary website display or streaming. Any payment required by applicable law or another applicable rights agreement remains unaffected.

This permission lasts while the contribution is provided through the service, plus limited retention needed for the purposes described in the Privacy Policy. You can request withdrawal or account closure. Retained discussion, approved credits, shared works, backups, and necessary legal or recovery records are handled under that policy; they do not give us a general right to republish withdrawn work. The separate permissions below govern compilations and promotion.

5. Optional free compilations and promotion

Account settings provide two independent choices for each artist identity: Allow free compilation releases and Allow promotional use. Both initially allow the use described here. The choices are presented to you, can be disabled independently, and apply to all published works belonging to that artist identity. There are no individual-work overrides. Authorized controllers share the same settings and may act only with the authority of the relevant rights holders. Private drafts, private forum posts, and unpublished submissions are excluded.

While the compilation choice allows use, you give 111 a non-exclusive, worldwide permission to reproduce, distribute, stream, publicly perform and display your published work as part of free, non-monetized compilation-style releases. While the promotional choice allows use, you give 111 the same limited permission to display, perform, reproduce, and distribute your published work or reasonable excerpts to promote 111, its artists, and their work, including through its website, social channels, and print materials. We may use the approved artist name, credits, and associated published artwork to identify the work. We will provide reasonable attribution and will not imply endorsement of an unrelated product.

These permissions include the necessary use by providers or distributors acting for 111 solely to carry out the permitted release or promotion. They do not allow those parties to exploit the work independently. Excerpts and technical formatting are allowed; remixes, substantive alterations, unrelated merchandise, and licensing the work for unrelated third-party uses require separate permission. These terms grant no permission to use contributions to train AI models.

Paid downloads, paid physical releases, revenue-generating streams, and other monetized uses require a separate artist agreement addressing rights and compensation. A free listener experience does not make a revenue-generating release non-monetized. No additional contractual fee is promised for the optional free uses described here; non-waivable rights and payments remain unaffected.

Opting out takes effect for new uses when your change is saved. It does not make an earlier authorized use unlawful or require withdrawal of a compilation or promotional item already released. Those previously released items may remain available in their existing form, subject to applicable law and valid safety, privacy, or infringement complaints. A new compilation, new edition, reprint, or new promotional placement after the opt-out requires renewed permission. Copies already lawfully distributed or downloaded cannot be recalled through an account setting. We retain a limited record of the permission and the earlier release so this boundary can be checked. Website publication is a separate choice and is not automatically withdrawn by these opt-outs.

6. Explicit and prohibited material

Mark a work Explicit if it includes permitted artistic nudity, explicit sexual language, graphic violence, or strong or repeated profanity. This applies to audio, images, writing, and their accompanying material. Artistic nudity is permitted only when it forms part of a larger artistic work; placing a standalone genital image inside a nominal frame, caption, or collection does not by itself meet that requirement.

Pornography, graphic depictions of sexual acts, standalone genital images, sexual exploitation or sexual content involving minors, and non-consensual intimate material are prohibited. This includes intimate impersonations or manipulated images shared without the depicted person's consent. An Explicit label does not make prohibited content acceptable.

Each explicit visual is blurred by default for eligible adults and requires a deliberate reveal for that work. Revealing one does not reveal others or permanently disable the default. Explicit audio and writing also remain behind adult-account access restrictions. Do not evade labels, put explicit material in unrestricted thumbnails or profile images, or distribute it through an unrestricted promotional preview. Authorized external releases and promotions must respect the content restrictions and applicable audience-protection requirements.

7. Treat people with respect

Do not use the forum, artistic work, titles, credits, profiles, links, or other parts of the service to bully, harass, threaten, stalk, or target another member. Do not encourage others to do so, publish another person's private information without authority, impersonate someone, or target people with hateful abuse. Criticism of ideas or work, disagreement, and challenging artistic expression are allowed within these boundaries; they are not permission to abuse a person.

Do not post unlawful material, infringe others' rights, upload malware, send spam, evade access controls, or disrupt the service. Forum access is restricted to approved members, but other members can read what you post. Do not treat it as a confidential communication channel or republish someone else's private contribution without permission or another lawful basis.

8. Reports, moderation, and review

Report concerns using the reporting controls or contact legal@111bpm.com. You do not need an account to contact us. Include the location of the material, what is wrong, and a way to reply. Do not send passwords, identity documents, or additional copies of intimate imagery unless specifically and securely requested for a necessary purpose.

For copyright complaints, identify the protected work, the allegedly infringing material and its location, your contact details, and your authority to act. Include a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the information is accurate and you are authorized to act, and your physical or electronic signature. We review complaints and applicable counter-notices, and may restrict or terminate repeat infringers in appropriate circumstances.

For intimate imagery shared without consent, identify the material and its location, state that it was shared without consent, provide your contact details and physical or electronic signature, and confirm that you are depicted or authorized to act for the depicted person. We promptly assess safety reports. Where the TAKE IT DOWN Act applies to a valid request, we remove the covered material and make reasonable efforts to identify and remove known identical copies within 48 hours. Other legally required reporting, preservation, and removal duties also apply.

We may seek clarification, correct a label, restrict visibility, remove material, or suspend or end access for a violation or serious safety risk. Human reviewers make these decisions. Where appropriate and lawful, we give the affected person the reason and a way to request review at legal@111bpm.com. We may act urgently without advance notice and limit disclosure when necessary to protect a person, an investigation, or confidential information. Good-faith reporting must not be used to harass others. Statutory complaint, appeal, and court remedies remain available.

9. Leaving, availability, and responsibility

You may stop using the service or request account closure through account settings or our contact address. The Privacy Policy explains the seven-calendar-day closure process and the material that may remain. Ending an account does not undo an already authorized compilation or promotional release, override another rights holder's rights, or prevent a legally required removal.

We take reasonable care in operating 111, but cannot promise uninterrupted availability, permanent storage, publication, or that another person's contribution will be accurate or suitable for you. Keep your own copies of your work. We may change or discontinue features, with reasonable notice where practicable and as required by law. Third-party sites have their own terms and privacy practices.

To the extent permitted by applicable law, the service is provided as available without additional warranties, and we are not responsible for indirect or consequential losses that the law permits us to exclude. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or other protected consumer rights. You remain responsible for your conduct and for having the authority needed for your submissions.

10. Changes and applicable law

We publish a dated version when these terms change and give appropriate notice of material changes. We seek fresh acceptance where required. New wording does not retroactively expand the rights granted in earlier submissions or override an opt-out. Any materially expanded use of work requires the relevant rights holder's permission.

California law governs these terms except where applicable mandatory law provides otherwise. If you are a consumer elsewhere, including in Canada or the European Union, you keep the mandatory protections and rights to bring proceedings available where you live. These terms do not impose mandatory arbitration, a class-action waiver, or an exclusive California court requirement. If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful.
